Violent rapist has new sentence imposed after Court of Appeal decision

A rapist who tried to pervert the course of justice with threatening text messages has had his sentence quashed after his case was heard before the Court of Appeal.

However, he will still spend nearly 10 years behind bars.

In a judgment released today from an August 1 hearing, Justices Mark Cooper, Timothy Brewer and Mary Peters allowed the man’s appeal, quashed his sentence for rape, and imposed a new length of imprisonment.

The man, whose identity is suppressed, was jailed for 10 years and two months after being found guilty of 12 charges for the violent rape of the mother of his child in June 2015.

He was visiting the woman to celebrate their son’s birthday before an argument ensued, the decision reads.

During the scuffle the man picked up a 30cm long stainless steel knife

High Court judges ‘uneducated’ for reducing rapist’s sentence

JOHANNESBURG – Non-governmental organisation Women and Men Against Child Abuse says two Pretoria High Court judges are uneducated after they reduced the life sentence of a man who forced his six-year-old stepdaughter to re-enact porn movie scenes with him.

The judges reduced the man’s sentence from life to 20 years in prison because they say he only forced the girl to have oral sex with him and that this did not constitute a severe rape case.

But Miranda Jordan-Friedman says her organisation is appalled by the judgment.

Judge H.R Fourie said while it was accepted that oral rape was disgusting and traumatic for the child, it didn’t result in any physical injuries or pain.

But Jordan-Friedman says this judgment is wrong.

“It is all the same as far as the long-term consequences, the betrayal and the shame. So obviously we have two very uneducated judges.”

She says it sends a message that oral rape is

Rapist model agency boss back in court

Johannesburg – Pre-sentencing proceedings for the model agency boss Dawie De Villiers will resume in the South Gauteng High Court on Thursday.

In February, the founder of Modelling South Africa (PTY) was found guilty of rape, sexual assault, sexual grooming, fraud, exposure of pornography to children and access to child pornography.

On September 12, the case was postponed after the judge had to attend to another matter. Sentencing has been postponed several times pending transcripts of the trial.

During the previous proceedings Prosecutor Arveena Persad argued that it was not in the interest of justice to allow De Villiers to continue to be out on R15,000 bail despite being found guilty of rape.

Persad, told the court that she would like to put it on record “that Judge Moosa has requested that the matter be heard at the High Court in Pretoria as he will be dealing with another matter there”.
