SANDUSKY, Mich. — A hearing is scheduled in Michigan on a judge’s order that initially gave a convicted sex offender joint legal custody of a child born to a woman who said the man raped her when she was 12.

Attorneys representing the woman and 27-year-old Christopher Mirasolo are to appear Tuesday afternoon before Judge Gregory Ross in Sanilac County.

Judge Didn’t Know He Awarded Joint-Custody To Alleged Rapist

The judge who awarded joint-custody of a child to the man accused of raping the child’s mother when she was 12 said he wasn’t aware of the rape allegations made against the father, according to a report in the Detroit News.

Christopher Mirasolo, 27, was awarded joint-custody of the child earlier this month by Judge Gregory Ross of Sanilac County in Michigan. In 2008, Mirasolo, pled out to a charge of attempted third-degree criminal sexual assault, or statutory rape, after being accused by the eventual child’s then 12-year-old mother of forcibly raping and threatening to kill her.

According to his attorney, Mirasolo did not initiate the child custody dispute and does not want custody of the boy. The case was presented to Ross by the state prosecutor after the mother made a plea for state assistance.

SANDUSKY, Michigan, October 13, 2017 (LifeSiteNews) — A county judge granted joint custody and the right to file for visitation to a rapist who impregnated a child’s mother.

Circuit Court Judge Gregory S. Ross gave Christopher Mirasolo joint custody over the child he conceived by raping Tiffany (last name withheld). Ross also informed the rapist of his victim’s home address. Her lawyer says she has even been commanded not to move more than 100 miles without prior consent of the court.

“Parenting time shall be as the parties agree,” Ross’ order decreed. “If they are unable to agree, either party may file a motion.”

The judge’s orders went into effect without Tiffany’s consent, according to her attorney, Rebecca Kiessling. She says Tiffany wasn’t even allowed an opportunity to be heard.

“This is outrageous and unacceptable,” Michigan Lt. Gov. Brian Calley posted on Facebook. “I will begin work immediately on remedies.”

A judge in Michigan signed an order allowing twice-convicted rapist Christopher Mirasolo joint custody of the boy – which he had not requested – without the mother’s knowledge after she applied for state benefits.

The woman was 12 when Mirasolo raped her in 2008. A plea deal meant he served less than a year behind bars for third-degree criminal sexual assault, according to US media.

The woman’s lawyer said the order, now put on hold, was “insane”. Rebecca Kiessling told Detroit News: “The judge also restricted the child’s domicile and residence, disclosed the rape victim’s home address to her rapist, and ordered his name on the birth certificate – all without the mother’s consent or any opportunity to be heard.”

Judge halts order giving rapist joint custody of child conceived in the crime

SANDUSKY, Mich. — A Michigan district court judge stayed his order Tuesday granting a rapist joint custody and parenting time as father of an 8-year-old boy after the judge learned details of the case.

The original problem? Apparently a standardized form, said Rebecca Kiessling of Rochester Hills, Mich., the lawyer for the boy’s mother. Kiessling also is co-founder of the group Hope After Rape Conception.

The boy’s mother had requested welfare benefits, according to a statement from the Sanilac County Prosecutor’s Office. To qualify for payments, she had to file a paternity complaint with the prosecutor’s office, which she did July 28.

Convicted rapist won’t seek custody of victim’s child: lawyer

A convicted sex offender in Michigan who raped a 12-year-old girl is not seeking custody of his victim’s 8-year-old son, according to his attorney.

Christopher Mirasolo, 27, of Brown City, was awarded joint legal custody and shared parenting time of the boy with an order signed on Sept. 22 by Sanilac County Circuit Judge Gregory S. Ross, according to the victim’s attorney, Rebecca Kiessling. But the fiend’s attorney, Barbara Yockey, said the matter is now being resolved privately and expects a scheduled Oct. 25 hearing on the case to be canceled, the Times Herald reports.

“He’s not going to attempt to see the child, no,” Yockey told the newspaper.

Kiessling, who is seeking to protect her client and her child under the federal Rape Survivor Child Custody Act, said a settlement was being discussed late Monday. Any deal, however, would need to be approved by Prosecuting Attorney James Young
