A judge has backtracked on a joint custody order given to a sex offender who impregnated a woman after raping her.

Christopher Mirasolo, from Brown City, Michigan, was granted joint legal custody and parenting time of an eight-year-old boy after a paternity test confirmed he was the father.

But yesterday Sanilac County Judge Gregory Ross ruled the 27-year-old did not have any parental rights towards the boy after his mother’s attorney sought protection under the federal Rape Survivor Child Custody Act.

SANDUSKY, Mich. — A Michigan judge has rescinded a controversial order he gave last month granting a convicted rapist joint legal custody of the child conceived when he attacked a 12-year-old girl in 2008.

Sanilac County Judge Gregory Ross ruled Tuesday that 27-year-old Christopher Mirasolo won’t have any parental rights in connection to the 8-year-old boy. But he’s still on the hook for child support.

Michigan Supreme Court spokesman John Nevin told The Associated Press last week that Ross didn’t know 27-year-old Christopher Mirasolo had two criminal sexual conduct convictions, including one concerning the woman.

The case started when the 21-year-old mother sought state assistance for her 8-year-old son.

Judge Didn’t Know He Awarded Joint-Custody To Alleged Rapist

The judge who awarded joint-custody of a child to the man accused of raping the child’s mother when she was 12 said he wasn’t aware of the rape allegations made against the father, according to a report in the Detroit News.

Christopher Mirasolo, 27, was awarded joint-custody of the child earlier this month by Judge Gregory Ross of Sanilac County in Michigan. In 2008, Mirasolo, pled out to a charge of attempted third-degree criminal sexual assault, or statutory rape, after being accused by the eventual child’s then 12-year-old mother of forcibly raping and threatening to kill her.

According to his attorney, Mirasolo did not initiate the child custody dispute and does not want custody of the boy. The case was presented to Ross by the state prosecutor after the mother made a plea for state assistance.

SANDUSKY, Michigan, October 13, 2017 (LifeSiteNews) — A county judge granted joint custody and the right to file for visitation to a rapist who impregnated a child’s mother.

Circuit Court Judge Gregory S. Ross gave Christopher Mirasolo joint custody over the child he conceived by raping Tiffany (last name withheld). Ross also informed the rapist of his victim’s home address. Her lawyer says she has even been commanded not to move more than 100 miles without prior consent of the court.

“Parenting time shall be as the parties agree,” Ross’ order decreed. “If they are unable to agree, either party may file a motion.”

The judge’s orders went into effect without Tiffany’s consent, according to her attorney, Rebecca Kiessling. She says Tiffany wasn’t even allowed an opportunity to be heard.

“This is outrageous and unacceptable,” Michigan Lt. Gov. Brian Calley posted on Facebook. “I will begin work immediately on remedies.”

A judge in Michigan signed an order allowing twice-convicted rapist Christopher Mirasolo joint custody of the boy – which he had not requested – without the mother’s knowledge after she applied for state benefits.

The woman was 12 when Mirasolo raped her in 2008. A plea deal meant he served less than a year behind bars for third-degree criminal sexual assault, according to US media.

The woman’s lawyer said the order, now put on hold, was “insane”. Rebecca Kiessling told Detroit News: “The judge also restricted the child’s domicile and residence, disclosed the rape victim’s home address to her rapist, and ordered his name on the birth certificate – all without the mother’s consent or any opportunity to be heard.”

A local prosecutor and judge in Michigan are under fire for giving a convicted rapist joint legal custody of his victim’s eight-year-old son. Christopher Mirasolo pleaded guilty in 2008 to attempted third-degree criminal sexual assault.
